# Updates to Terms of Service

Agents are reshaping the tools developers use, the applications they build, and the infrastructure that runs them. We’ve updated our [Terms of Service](http://vercel.com/terms) and [Privacy Policy](http://vercel.com/privacy) to reflect how Vercel uses data to support agentic features, improve our platform, and contribute to the AI ecosystem.

## **What is changing?**

### **Agentic infrastructure capabilities**

We are developing features that allow Vercel to do more to keep your apps running efficiently, including:

- Proactively investigating and mitigating incidents
- Analyzing web app performance data and suggesting improvements
- Identifying where your spend is going and creating PRs to optimize usage

Vercel may also use data to help improve our tools to fight fraud and abuse of the Vercel platform.

### **Optional AI model training**

You may choose whether to allow Vercel to:

- Use your code and Vercel agent chats to improve Vercel models
- Share your code and Vercel agent chats with AI model providers

### **Defaults by plan for optional AI model training:**

- **Hobby (including Trial Pro):** Opted in for AI model training by default, with self-serve opt-out in Team and Project Settings
- **Pro (paid):** Opted out of AI model training by default, with self-serve opt-in in Team and Project Settings
- **Enterprise:** Opted out of any AI model training

Sharing this data helps improve the performance of agentic tools for everyone. **Participating in this model training program is fully optional, with easy opt-out in **[**Team Settings → Data Preferences**](https://vercel.fyi/team-data-preferences)**.**  If you choose to opt out by March 31st 2026 11:59:59 PST ,Vercel will not use your data to train AI or share it with third parties. If you choose to opt out after March 31st 2026 11:59:59 PST, your data will not be used or shared from that point forward.

If you are opted in, the training datasets would include:

- Code and Vercel agent chats
- Build and deployment telemetry data and build errors
- Aggregate traffic stats

All personal information, account details, environment variables, API keys, and other sensitive content is anonymized and redacted before use or sharing.

Other changes to our Terms of Service include updated dispute resolution processes, billing practices, and provisions to reflect compliance with the latest data protection laws. While arbitration has always been our method of resolving disputes with international and Enterprise customers, it now also applies to U.S.-based customers. The opt-out process described in Section 21 of our Terms of Service is unchanged.

**How can I opt out of data sharing?**

1. Click [**<u>Team Settings</u>**](https://vercel.fyi/team-data-preferences)** **in the top left of your dashboard (not Account Settings)
2. Click **Data Preferences **
3. Toggle from Opt-In to Opt-Out

**What if I want to opt into and out of data sharing at the Project level?**

1. Set your **Team Level** setting to Sharing
2. Then click** **[**Project Settings**](https://vercel.fyi/project-data-preferences) to opt out individual projects

**When do I have to opt-out before my data is shared?**

If you opt out by March 31, your data will not be used or shared for AI model training.

**How long will it take for the opt-out to take effect?**

When you opt out, your choice applies immediately to future data sharing going forward. Data that may have been shared before you opted out can’t be unshared retroactively.

**How does Vercel use data for training?**

We share code and v0 prompt data, as well as telemetry on deployments and builds, errors encountered, and aggregate web traffic stats. This data is anonymized and redacted of all personal information, account details, environment variables, API keys, and other sensitive content. This data may be used to improve our services and provided to third parties for AI model training purposes only.

**Why is Vercel sharing this data?**

Coding agents have become valuable co-workers to developers. However, code that is unable to be deployed or that hinders performance is not helpful. We use and share this data to train AI models on what a high functioning and performant website, application, or agent looks like.

**Can I opt out of Vercel using my data to improve autonomous platform capabilities?**

Pro and Hobby users cannot opt out of Vercel using customer data to improve and develop products, including improvements to the safety of our platform, in ways that do not involve training an AI model. Pro and Hobby users can opt out of Vercel using data to train Vercel's own AI models and those of AI model providers. Enterprise customers are never opted in for their data being used to improve or develop products, or for AI model training.

**What does it mean for my data to be anonymized?**

We use industry-standard tools to anonymize code, prompts, and usage data before it's ever used or shared to train AI models. Anonymization means any details that identify you or your organization (like names, email addresses, account details, environment variables, API keys, and other sensitive content) are removed or replaced with generic placeholders, so the data cannot be traced back to you.

**Is there anything required of me to opt out of AI training?**

If you are a Hobby (or trial Pro) customer, you can opt-out in Settings. Every Team and Project owner is able to opt-out in their Team and Project settings. You can manage your preferences in[ Team Settings → Data Preferences](https://vercel.fyi/team-data-preferences).

Paid Pro and Enterprise customers are opted out by default. Paid Pro customers can opt-in to training in Team Settings. There is no mechanism for Enterprise customers to opt-in to training.

**Does this apply to open-source projects like Next.js, AI SDK, or shadcn/ui?**

No. These changes apply only to data from the Vercel platform. If you use Vercel open-source projects — including Next.js, AI SDK, shadcn/ui, Turbopack, and others — without a Vercel account, your data is not subject to these terms and will not be used for model training.

**What prompt data will be shared?**

For Vercel customers that use v0, we may share anonymous v0 chats.

**Will you use my Account Information (e.g., username, email, billing address) for AI training?**

No. Your Account Information will not be part of any AI training data set. We may use your Account Information to help improve our tools to fight fraud and abuse of the Vercel platform.

**As a v0 only user, what does this change mean for me?**

- You can manage your preferences in your Vercel account at [ Team Settings → Data Preferences](https://vercel.fyi/team-data-preferences)
- If you are a v0 Free or Premium user with a Vercel Hobby account, you will be opted into AI training by default
- Any other v0 user will be opted out of AI training by default
